It is unfortunate if president formulates any political cell: CJP

ISLAMABAD: Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry remarked Monday president was symbol of federation and if he formulated any political group it would be very fortunate.
CJP gave these remarks while presiding over a 3-member bench of Supreme Court (SC) during the course of hearing of case on distribution of money by establishment among the politicians in connection with formation of IJI.
Aiwan-e-Sadr secretary Asif Hayat Bajwa told the court no political cell was operating in Aiwan-e-Sadr at present as per his knowledge. Aiwan-e-Sadar functioned in Rawalpindi in the past and the court could be informed about the presence of any political cell in the past after checking the record. Therefore, some time be allowed by the court in this respect, he prayed. Reply from Aiwan-e-Sadr would be presented subject to availability of complete record, he added.
Presenting his written reply in the court, former bureaucrat Rodad Khan said he did not meet General Aslam Beg even for one time. Ijlal Haider Zaidi did not make mention of any political cell. Ehtesab cell was operating in cabinet division which was working on behalf of the president, he said.
Justice Jawad S Khawja remarked the facts of this case would be beneficial for the nation when they came to open. Political cell was constituted in ISI and we are finding out its foundation. The connectivity of ISI political cell with Aiwan-e-Sadr can be seen on the record, he added.
Former ISI chief Lt Gen (Retd) Asad Durrani said Rouedad Khan had nothing to do with election cell. Gen Beg and Ijlal Haider Zaidi gave him orders and he complied with them , he added.  Brig Hamid Saeed used to distribute money, he indicated.
CJP inquired from former ISI chief Lt Gen (Retd) Asad Durrani “ you had taken oath then as to why you did this job.
Justice Jawad S Khawaja observed “     Assist the court in respect of Brig Hamid. Perhaps he may be served upon a notice.
Suleman Raja counsel for Asghar Khan said former Army Chief Wahid Kakar wrote former general Aslam Beg and Asad Durani tried to involve the army.
CJP observed “ It is in the national interest that army safeguards the borders and who is to be brought to corridors of power, it is job of the people. Why the army and ISI be blamed because of only one person. President is president of the country and not of IJI. Election be held in transparent manner. Parliament and judiciary are working in the country currently. Several things have crystallized. It is to decide what is role of the institutions. We are heading towards it. We laud the efforts from Asad Durrani but as a sepoy and general he should have delivered oath of upholding the constitution, he further remarked.
Chief Justice Supreme Court Iftikhar Muhammad Chaudhary has said that entire army or ISI cannot be blamed for misdeeds of one person.
This he said during his remarks on Monday while hearing the Asghar Khan’s petition regarding distribution of money by ISI among the politicians. He was heading the three member jury.
The former Director General Inter Services Intelligence (ISI) Lt. Gen(R) Asad Durrani told the court that he gave hefty amount of Rs 70 million to the politicians on the instructions of ex President Ghulam Ishaq Khan and Chief of Army Staff at that time, General Aslam Baig. The money was distributed through Brig Hamid Saeed.
Former ISI Chief Durrani said in his statement that he was told that giving money to political leaders would be in national interest.
Chief Justice Iftikhar Chaudhary said in his remarks that Gen Asad Durrani, while in uniform not only executed an unlawful act but also violated his oath of the office as a soldier and commander, however he appreciated him for tell truth to the court.
CJP said that it is in the best national interest that army should protect the frontiers of the country .Electing the leaders is the function of the people, not army. It would be wrong to hold responsible army or ISI because of wrong action of a single man
“President is head of entire country not any of any fraction or party like IJI. Today courts and parliament is performing their duties. Now many things have been clarified. Now free, fair and impartial elections are the need of the country”, Chief Justice added.
Secretary Aiwan-e-Sadr Asif Hayat also appeared before the court, who informed the bench that the case pertained to that time, when Presidency was situated at Rawalpindi.
“At present I do not know about the availability of old record, so the court may give some time to trace out the record.” he added. On which the court gave him time till Wednesday.
Justice Jawad S. Khawaja said that the record presented before court has some clues of ISI’s Political Cell in the regime of former late presidents Ghulam Ishaq Khan and Farooq Ahmed Khan Laghari.
He said that the whole country would be benefited, if the facts would be unveiled in the case. The court is searching the foundation of political cell in ISI
Former Bureaucrat Roidad Khan said in his written reply that he never met with General Aslam Baig throughout his life. He said that the former Secretary Defence Ijlal Haider Zaidi did not tell him about any political cell, which used to work on behalf of Aiwan-e-Sadr.
Salman Raja Counsel of Air Marshal(R) Asghar Khan said during his argument said that former Army Chief General Waheed Kakar wrote that Aslam Baig and Asad Durrani tried to involve the army in the matter. –Online
